Terms of service
Last updated 30 September 2026 · Slovenská verzia
Part A applies to everyone who uses bergbooking (formerly booq). Part B adds the rules for businesses that list a place on bergbooking. If the English and Slovak versions differ, the Slovak version prevails.
1. Who we are
bergbooking is operated by MONTBERG s. r. o., Oravská 3237/15A, 903 01 Senec, Slovak Republic, company ID (IČO) 57 659 729, registered in the Commercial Register of the Municipal Court Bratislava III, section Sro, file no. 200096/B ("we", "bergbooking"). Email: hello@bergbooking.com, phone: +421 949 407 314. The email address is also our single point of contact for users and for authorities under the Digital Services Act; we communicate in Slovak and English. The supervisory authority for consumer matters is the Slovak Trade Inspection (Slovenská obchodná inšpekcia), Inšpektorát SOI pre Bratislavský kraj, Bajkalská 21/A, P. O. BOX č. 5, 820 07 Bratislava 27, soi.sk.
2. What bergbooking is
bergbooking is an online marketplace: businesses such as sports centers, studios and clubs publish their availability, and people book it, join open games, trainings and run clubs, and message each other. bergbooking provides the software. It is not a party to any booking and does not provide the booked service. bergbooking is free for players. By creating an account you enter into a contract with us on these terms, and you confirm you have read the privacy policy.
3. Your account
- You must be at least 16. Under 16 you may use bergbooking only with a parent's or guardian's consent.
- Use your real name. Other participants and the businesses you book with rely on it.
- You sign in with a one-time email code, Sign in with Apple or Google. Keep your inbox and devices secure; anything done from your account counts as done by you until you tell us otherwise.
- You can delete your account at any time in the app or on the web (Account → Delete Account). As a consumer you may also withdraw from this contract within 14 days of creating the account: email us a message such as "I withdraw from the contract for the bergbooking account registered to [your email]" with your name and the date. Deleting the account has the same effect.
4. Bookings, games and trainings
- Your contract is with the business. When you book a slot, join a game or sign up for a training, the agreement is between you and the business or the organizer. Businesses on bergbooking declare that they act as traders, so consumer law applies to your contract with them. The business is responsible for the place, the price, availability, its cancellation policy, refunds, receipts and everything that happens on site. bergbooking is responsible for the app, your account, notifications and the payment tools.
- Prices are set by the business and shown in euro as the business entered them. You pay the price shown when you book; bergbooking adds no charge for players.
- Ranking. Places you marked as favorites come first. The rest are ordered by distance from your location when you allow location access, otherwise alphabetically by name. Your activity and indoor/outdoor filters only narrow the list. Nobody can pay for a better position.
- No 14-day withdrawal for bookings. A booking for a specific time is a leisure service under §19(1)(l) of Act No. 108/2024 Coll., so the statutory right of withdrawal does not apply. The business's cancellation policy applies instead.
- Cancellations and moves. Each business sets a cancellation cutoff, shown before you book. Before the cutoff you can cancel in the app and move the booking once to another slot at the same business (to another zone only if the price and duration match). Inside the cutoff, bookings can no longer be changed or cancelled in the app. Managers of the business can move or cancel bookings at any time.
- How you pay. At the place; by bank transfer using the QR code or links in the app, where you mark the booking as paid and the business confirms it; or, where the business has enabled it, by card through Stripe on the business's own Stripe account, including Apple Pay on iPhone. During a card payment the slot is held for you for 15 minutes in the app and about 30 minutes in the web checkout, then released.
- Card refunds. If you cancel a card-paid booking before the cutoff, the full amount is refunded to the original card without any action on your part. After the cutoff, a refund is at the business's discretion; its managers can refund through bergbooking at any time. Every refund made through bergbooking returns the full amount, including bergbooking's fee, which bergbooking returns to the business. Banks typically show it within 5 to 10 business days. bergbooking never holds your money; Stripe executes every payment and refund.
- Benefit cards. If you tick that you pay with a benefit card, the business checks the card on site under its own rules.
- No-shows. A business may mark a booking as a no-show. Repeated no-shows may lead a business to refuse you, and us to suspend or close your account.
- Open games and run clubs. The organizer decides who joins. Games and clubs are often organized by private players, not businesses; consumer law does not apply to your arrangement with a private organizer. You take part in sport at your own risk and are responsible for your own conduct and fitness.
- Reviews. After a finished booking you may rate the place once and edit your review later. Reviews must describe your own experience honestly. The business may reply. A review is deleted with your account or with the business's listing.
- Weather warnings come from Apple Weather and are informational only. They do not cancel a booking or trigger a refund by themselves.
5. Conduct and content rules
Games, trainings and chats involve real people. The following is not allowed anywhere on bergbooking, in profiles, messages, reviews or listings:
- illegal content of any kind, including content that infringes someone's rights;
- harassment, threats, hate speech, sexual content, or sharing another person's personal data;
- impersonation, fake names, fake reviews or misleading listings;
- spam, unsolicited advertising, or using bergbooking to arrange bookings outside bergbooking to avoid a business's rules or fees;
- scraping, automated access, or interfering with the security or operation of bergbooking.
We review content manually when it is reported or when we notice it; we use no automated moderation. Depending on the seriousness we may remove or reset content, hide a listing, restrict features, or suspend or terminate an account. We act diligently, objectively and proportionately, and we take the rights of everyone involved into account.
6. Reporting content and our decisions
To report content you believe is illegal or breaks these rules, email hello@bergbooking.com with: where the content is (a link or a description of where to find it), why you consider it illegal or against the rules, your name and email, and a statement that you believe your report is accurate and made in good faith. We confirm receipt, decide without undue delay, and tell you the outcome.
If we remove content or restrict, suspend or terminate an account, we send the affected person a statement of reasons: what we did, the facts, the rule or law it rests on, whether automated means were involved (they are not), and how to object. To object, reply to that email; a person re-examines the decision.
7. Your content
You keep ownership of what you post (photos, messages, bios, reviews). You grant us a licence to store it and show it to its intended audience for as long as it is on bergbooking. You must have the rights to what you post. Businesses are responsible for the content of their listings.
8. Suspension and termination
You may leave at any time by deleting your account. We may restrict, suspend or terminate an account for breaches of section 4 or 5, for payment abuse or fraud, when the law requires it, or to protect the security of bergbooking. For termination we give 30 days' notice, except for serious or repeated breaches or where the law requires immediate action. Every such decision comes with the statement of reasons described in section 6.
9. Availability and liability
bergbooking runs on iPhone with iOS 26 or later and in current versions of Safari, Chrome, Firefox and Edge; updates arrive through the App Store and automatically on the web. bergbooking is provided with reasonable care, is in active development, and may occasionally be unavailable or change. bergbooking is not responsible for the services of businesses, for the conduct of other users, or for injuries during activities booked through bergbooking. To the extent the law allows, we are not liable for indirect damage or lost profit. Nothing in these terms excludes or limits our liability for death or personal injury, for intentional or grossly negligent conduct, or any right that consumer law gives you and that cannot be waived.
10. Complaints and disputes
Complaints go to hello@bergbooking.com; we answer within 30 days. If you are a consumer and we reject your complaint or do not resolve it within 30 days, you may submit a proposal for alternative dispute resolution to the Slovak Trade Inspection (soi.sk) or to another body on the list kept by the Ministry of Economy of the Slovak Republic (mhsr.sk). These terms are governed by the law of the Slovak Republic; mandatory consumer protections of the country where you live remain unaffected. Disputes are decided by the courts of the Slovak Republic.
11. Changes to these terms
We may change these terms when the law changes, when we add or change features or payment options, for security reasons, or to correct errors. We tell you by email or in the app before a change takes effect, at least 15 days before for changes that matter. Changes never apply retroactively. If you disagree, delete your account before the change takes effect; continuing to use bergbooking afterwards means you accept the new terms.
Part B. Businesses
B1. Who this applies to
Part B applies to every business that lists a place on bergbooking and to the managers acting for it. By creating or managing a business you confirm that you are entitled to represent it, that it acts as a trader, and that you accept these terms and the billing terms on its behalf.
B2. Your listing
- Keep prices, hours, photos, cancellation cutoff, payment methods and contact details accurate, and honour every booking made through bergbooking.
- Anything you publish, including your IBAN or Revolut tag if you enable transfers, is visible to anyone browsing bergbooking, with or without an account.
- You are responsible for complying with the law that applies to your business, including receipts, invoices and tax on what you sell to players.
- Information about participants may be used only to run the booked session, in line with data-protection law. You are a separate controller for the data you receive; no marketing to players without their consent.
B3. Plans and fees
Plans (Free, Standard, Advanced, Pro), prices, billing and cancellation are in the billing terms. Card payments carry a bergbooking platform fee per booking, shown in the app when you enable card payments and at any time afterwards in Edit Business; we notify you before and after any change to it. Stripe deducts the fee from each payment; for every month in which you had card bookings we email you, on the first day of the following month, an invoice for those fees, already settled, for your records.
B4. Card payments through Stripe
Payment processing services for businesses on bergbooking are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together the "Stripe Services Agreement"). By agreeing to these terms or continuing to operate as a business on bergbooking, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of bergbooking enabling payment processing through Stripe, you agree to provide bergbooking accurate and complete information about you and your business, and you authorise bergbooking to share it and transaction information with Stripe.
Card payments run on your own Stripe account: you are the seller of record, you receive the money, and you own refunds, disputes and chargebacks. Every refund made through bergbooking returns the full amount to the player, including bergbooking's fee; Stripe's processing fee on the original payment is not returned. Your statement descriptor comes from your own Stripe settings. Stripe may ask you for identity and business documents.
B5. Ranking and equal treatment
Places the player marked as favorites come first; the rest are ordered by distance from the player's location when the player allows location access, otherwise alphabetically by name. The player's activity and indoor/outdoor filters narrow the list. Your plan never affects your position, and ranking cannot be bought. bergbooking lists no places of its own. Plans differ only in features and monthly booking limits. You may offer your slots elsewhere at any price; bergbooking imposes no parity.
B6. Data
You see, for your bookings: the player's name, tag, photo, bio, gender and age, the booking details, the note and the payment status; statistics on the Pro plan; and, on the Pro plan, booking exports by email. bergbooking keeps all data generated on its systems, including after your listing ends, as described in the privacy policy. Data needed to run the service is shared with Stripe, Apple, Resend and our hosting providers; this cannot be opted out of. We share nothing with third parties for their own purposes.
B7. Marketing channels and intellectual property
We may show your listing, name and photos in bergbooking's own channels: the App Store listing, the website, social media and newsletters. You keep all rights to your content and grant us a licence to display it on bergbooking and in these channels for as long as your listing is live.
B8. Tax reporting
bergbooking may be a reporting platform operator under the DAC7 rules (§22h and following of Act No. 442/2012 Coll.). If so, you must give us your legal name, seat, IČO, DIČ, VAT number, bank account and the address of each place, and we may report your bookings and consideration to the Slovak tax authority by 31 January each year. You receive a copy of what we report.
B9. Suspension, termination and changes
We may restrict or suspend a listing for the reasons in section 5, for repeated failure to honour bookings, for payment abuse, when the law requires it, or to protect the security of bergbooking, and we send you a statement of reasons before or when the measure takes effect. We may end your listing with 30 days' notice and reasons, or immediately for repeated breaches or when the law requires it. You may end it at any time by writing to us and we remove the listing; past bookings are retained as the law requires. Changes to Part B or the billing terms are notified by email at least 15 days before they take effect, never apply retroactively, and you may end your listing before then. Shorter notice applies only when a change is required by law or by an urgent security risk.
B10. Liability and complaints between businesses and bergbooking
Toward businesses, bergbooking's liability for any event is limited to the fees the business paid to bergbooking in the 12 months before it, except for intent or gross negligence. Business complaints go to hello@bergbooking.com and are answered within 30 days. Disputes with businesses are governed by Slovak law and decided by the courts of the Slovak Republic.
